Terms of service

Using Retake Design.

These terms describe use of the design workspace, your responsibilities for uploaded and generated content, and how Credits and subscriptions work.

The service and your account

Retake Design provides account sign-in, cloud project storage, Canvas editing, and AI generation. Keep your sign-in account secure and use the service only for lawful purposes. Do not attempt to access another user's projects, bypass usage controls, or disrupt the service.

Your content

Use only assets, prompts, brand facts, and source material that you have the right to process. Review generated results for accuracy, safety, platform compliance, and required disclosures before publishing.

AI acceptable use policy

This section applies to prompts, uploaded references, generated text and images, image edits, and content stored or used through Retake Design. These content standards, reporting procedures, and enforcement measures form part of these Terms of Service.

Last updated: September 14, 2026.

Content standards and prohibited categories

Do not use Retake Design to request, generate, edit, upload, store, or distribute the following:

  • Pornography / NSFW: sexually explicit imagery, sexual acts, fetish pornography, or sexual exploitation. This includes attempts to undress a person in an image.
  • Violence / gore: graphic injury, mutilation, torture, or content that threatens, encourages, or celebrates violence. Terrorist recruitment and instructions facilitating mass violence or weapons of mass destruction are prohibited.
  • Hate speech: content attacking, dehumanizing, or inciting discrimination or violence against people based on protected characteristics such as race, ethnicity, religion, sex, gender identity, sexual orientation, or disability.
  • Child-unsafe content / CSAM: child sexual abuse material, sexualized depictions of minors, grooming, or other child exploitation or endangerment. This prohibition applies to real, fictional, and AI-generated depictions.
  • Deepfakes / impersonation: deceptive depictions that impersonate a real person, brand, or organization; non-consensual intimate imagery; fabricated endorsements; or edits falsely presenting someone as participating in an event or activity.
  • Copyright / trademark infringement: content made or used without the rights or permission required by law, including unauthorized copying of protected artwork and misleading use of logos or trademarks. Possessing a reference image does not establish permission to reproduce it.

Fraud, harassment, privacy violations, and attempts to bypass safety controls are also prohibited. A successful generation is not approval of its content. You remain responsible for checking the result before using or publishing it.

Content review and moderation

Retake uses third-party AI services whose safety controls may reject a prompt or generation. Where a provider reports a safety block, the request is shown as unsuccessful. Provider filtering varies by service and is not a guarantee that every input or output has been checked or is safe.

Reports sent to support provide a route for manual review. Review considers the identified prompt or image, relevant account or request records, the reported harm, and the context supplied by the reporter and affected user. Access should be limited to information needed to investigate and take action, consistent with our Privacy Policy. We do not promise real-time human review of every generation or a round-the-clock moderation team.

Report unsafe content or infringement

Email support@retake.design with the subject “Content safety report”. Include a relevant link or request reference, the category of concern, and a short explanation. For a rights complaint, identify the protected work or mark and your authority to report it.

Do not send passwords, full card information, or copies of suspected CSAM. Report its location or reference instead. If someone is in immediate danger, contact the relevant emergency authority; this mailbox is not an emergency service.

Enforcement and appeals

Depending on severity and evidence, we may warn the user, require content changes, remove or disable access to content, restrict features, suspend an account, or terminate access for serious or repeated violations. Child exploitation and urgent threats warrant priority attention; suspected unlawful activity may be reported to competent authorities as required or permitted by law.

Where appropriate, we will communicate the outcome to the affected user without disclosing another person's private information. To dispute a decision, email support@retake.design with the decision reference and relevant context. An appeal requests reconsideration; it does not automatically restore access. Liability and billing consequences are addressed in our Terms of Service.

Violations, suspension, and termination

If you violate these terms or the AI Acceptable Use Policy, we may issue a warning, require correction or removal of content, restrict generation or other features, suspend access while a matter is reviewed, or terminate your account for serious or repeated violations. Measures will take account of the severity, risk of harm, and available evidence. Urgent safety risks, suspected fraud, or legal requirements may require action without advance notice.

Where lawful and appropriate, we will explain the action and how to appeal. Send appeals to support@retake.design. Do not create another account to evade a restriction. We may preserve relevant evidence and cooperate with lawful requests from competent authorities.

You are responsible, to the extent permitted by applicable law, for losses and reasonable costs directly caused by your unlawful conduct or breach, including third-party rights claims arising from content you submit or misuse of the service. Any compensation claim must have a lawful basis and reflect the circumstances; this provision does not impose an automatic penalty or remove non-waivable consumer rights. Suspension or termination does not automatically forfeit refund rights or settle outstanding billing questions; contact support about paid access and unused Credits.

Generated output

AI output can be incomplete or wrong. Editing tools and previews do not guarantee legal, advertising, marketplace, or brand compliance.

Credits

AI operations use a server-managed Credit balance. Reservations hold Credits while a request runs; completed work is charged and unused reservations are released according to the operation result. Review charges and releases in Credit activity. Test checkout and test refunds do not represent real-money payments or refunds.

Subscriptions and renewal

Review the price, billing interval, taxes, and renewal terms shown before confirming checkout. Subscriptions renew unless renewal is canceled. Use Plan & billing to manage your subscription; scheduled cancellation keeps access through the displayed paid period and does not itself issue a refund. Review the price difference and effective date before confirming a plan change.

Credit validity

Included subscription Credits expire at their next entitlement boundary. Monthly plans issue one grant per paid period; annual plans are billed annually and issue one monthly entitlement 12 times. Purchased Top-up Credits do not expire. Current offers and included amounts are shown on Pricing and at checkout.

Payment questions and refunds

Contact support with your account email and transaction reference for billing errors or refund requests. Do not send card details or passwords. Cancellation and refunds are separate actions; submitting a request does not mean a refund has been approved. Nothing in these terms removes rights you have under applicable consumer law. A checkout explicitly marked Test mode does not charge real money.

Availability and support

AI results and service availability are not guaranteed to be error-free or uninterrupted. Save and export important work. Contact support for account, payment, or service issues; the support contact does not imply a guaranteed response time or uptime commitment.
